DWW - Web Club terms and conditions

TERMS and CONDITIONS of Membership

You must read and agree to these terms and conditions before you can join the DWW WEB CLUB.
Please read them!

 

1. By enrolling in DWW's WEB CLUB SERVICE, you become a Member and Subscriber and agree to be bound by this Agreement. This agreement is subject to change by DWW Handelsgesellschaft mbH. (DWW) at any time, and changes are effective upon notice to each Subscriber.
   
2. Subscription fees are non-refundable.
   
3. DWW reserves the right to refuse membership on any grounds whatsoever without reason.
   
4. A subscription may not be assigned or transferred to any other person or entity. A subscriber must promptly inform DWW of the following: changes in home or billing address; changes of email address or internet provider; apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. Until DWW is notified, by email, or by telephone at +44 20 8133 2014 of a breach in security, the Subscriber will remain liable for any unauthorized use of the WEB CLUB SERVICE.
   
5. Subscription to the WEB CLUB may be terminated at any time and without cause by the Subscriber upon notification of DWW by electronic or conventional mail, or by telephone. Subscription fees are NOT refunded.
   

6. Subscription to the WEB CLUB may be terminated at any time by DWW without notification of the customer, if the subscriber violates this contract, especially if the Subscriber illegally trades, rents or advertisements his ID or password or if the Subscriber misuses the WEB CLUB SERVICE and violates basic rules, especially if the Subscriber submits or publishes or displays any defamatory, inaccurate, abusive, threatening, racially offensive, indecent, unauthorized or illegal material on the WEB CLUB SERVER or if the Subscriber misuses one of the public bulletin boards for commercial advertising. When termination is due because of violation of this contract, subscription fees are NOT refunded. DWW reserves its rights to take legal action against a Subscriber who violates the agreement, esp. if basic rules of that agreement were significantly violated.

    

7. Password trading is not permitted under the terms of the Subscriber's membership. It is fraud. It is neither fair nor legal. DWW controls all access to the WEB CLUB by the Subscriber's IP-address. If DWW will see that two different users are using the same password, DWW will discontinue that access immediately, refuse all future orders for membership from those IP-addresses DWW believes to have used them and DWW reserves the right to take legal action against the password owner. Don't trade your password!
   
8. Subscribers are responsible for providing all personal computer and communications equipment necessary to gain access to the WEB CLUB SERVER. Access to and use of the Service is through a combination of an ID and a password. Each Subscriber must keep his password strictly confidential. Remember and SAVE your password! For security reasons, DWW will not release passwords for any reason, exceptions may be specifically required by law or court order. Unauthorized access to the Server is a breach of this Agreement and a violation of law.
   
9. Any liability of DWW including without limitation any failure of performance, error, omission, interruption, deletion, defect, delay inoperation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortous behavior, negligence, or under any other cause or action, shallbe strictly limited to the amount paid by or on behalf of the subscriber to DWW for the time the Subsriber is (was) a Member and Subscriber.
   
10. No warranty is made by DWW regarding any information, services, or products provided through or in connection with the WEB CLUB Service, and DWW hereby expressly disclaims any and all warranties, including without limitation any warranties as to the availability, accuracy, or content of information,products, or services and any warranties of merchantability or fitness for a particular purpose.
    
11. Computer equipment is not infallible. Technical and hardware problems may occur from time to time and DWW will always try to solve those within its competence as soon as possible, especially server failure. However, DWW cannot take responsibility for problems outside its direct remit (i.e. providers or telephone companies) and DWW is unable to refund subscriptions. If technical failings within DWW's remit exceed more than 7 full days of any one calender month, DWW will adjust the expiry dates of all current memberships to one month later than booked. NO cash refunds under any circumstances.
    
12. Except for electronic messages, all material produced and distributed by DWW, whether through the Web Club or other means is the intellectual property of DWW and remains its copyright. All rights the producer and owner are reserved. DWW gives limited permission to Registered Members of the Web Club to download once only the pages for which they have registered for their sole personal use. Other copying, sale, hiring, lending, public performance, broadcasting, redistribution, or other reproduction, in whole or in part, is prohibited without specific written authorisation from DWW.
    
13. The material on the Service is for the private, non-commercial enjoyment of Subscribers only. Any other use is prohibited.
    
14. DWW enables Subscribers to share information, upload advertisements to search for wrestling partners, etc., to communicate with other Subscribers. Subscribers agree NOT to submit, publish, or display on the Server any defamatory, inaccurate, abusive, threatening, racially offensive, indecent or illegal material or information. Subscribers agree NOT to submit, publish or display on the Server any commercial advertisements (i.e. for sales or rent of any products; agencies or companies offering or searching a model; advertising for prostitution; etc.). Transmission of such material and/or material that violates any federal, state, or local law, is prohibited and is a significant breach of this Agreement.
    
15. Subscribers are responsible for information they send, or display through the WEB CLUB Service even if a claim should arise after termination of service.
    
16. There are no facilities provided by the WEB CLUB Service for sending or receiving private or confidential electronic communications. All messages shall be deemed to be readily accessible to the general public. Do not use the WEB CLUB for any communication for which the sender intends only the sender and the intended recipient(s) to read. Notice is hereby given that all messages entered into this WEB CLUB can and may be read by the operators of the Service, whether or not they are the intended recipient(s). DWW reserves the right to censor and/or to delete any messages and emails sent to the DWW WEB CLUB SERVER, without notification of the Subscriber and without any cause or reason whatsoever.
    
17. Notices by DWW to Subscribers may be given by means of electronic messages through the WEB CLUB, by a general posting on the service, or by conventional mail. Notices by Subscribers may be given by electronic messages or conventional mail, unless otherwise specified in the Agreement.
    
18. All questions, complaints, or notices to DWW by means of electronic message must be sent to dww(at)dwwgalaxy.com
    
19. The subscriber hereby warrants and represents that he or she is over the age of 18, and in all respects is qualified and competent to enter into this agreement, and that viewing and using the adult material presented on the DWW WEB CLUB SERVER does not offend the SUBSCRIBER's local laws.
    
20. Membership will entitle the Subscriber to view and to download photos and movies for his own use and to upload personal non-commercial advertisements only. This membership is not transferable. Use by persons other than the Subscriber will result in a cancellation of his membership. Under no circumstances should the Subscriber allow the material and images to be viewed by minors.
    
21. The Subscriber is allowed to use the WEB CLUB SERVICE with only one internet provider of his choice. The Subscriber must tell us if and when he will change his Internet Provider. If multiple access by one user ID is detected from different sources, the ID and the subsequent password will be quoted as to be illegally traded and the server account will be terminated without refund. The same will happen if one user ID will try to access from two or more different sources at once.
    
22. From June 8th 2008 all prices for EU-citizens and prices for orders coming from the EU include 20% VAT
23. This Agreement contains the entire agreement between the Subscriber and DWW regarding the use of the WEB CLUB, and supersedes all prior written and oral understandings and writings, and may only be amended upon notice by DWW to Subscribers. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its terminations.
